1. When is a Building Permit required?

A building permit is required whenever a project includes construction, reconstruction, alteration, repair, removal or demolition of a structure; change in use of a building or structure; or installation or alteration of any equipment that is regulated by the State Building Code.
This includes, but is not limited to, new structures, additions, dormers, chimneys, woodstoves, decks, roofing, siding, swimming pools, antennae, and sheds. The only exception is an ordinary repair.

2. What if I start work without a permit?

Failure to obtain a building permit or starting work before a permit is issued may result in increased permit fees, fines up to $1000 per day, imprisonment or any or all of the foregoing.

3. What is an ordinary repair?

The Commonwealth's Building Code defines ordinary repairs as "any maintenance which does not affect structure, egress, fire protection systems, fire ratings, energy conservation provisions, plumbing, sanitary, gas, electrical, or other utilities.”
This has been interpreted to mean that rotted floor boards can be replaced on a deck, but the deck cannot be rebuilt without a permit. Also, damaged roof shingles can be repaired, but the entire roof cannot be re-shingled without a permit. If in doubt as to how much work can be done under ordinary repairs, contact the Building Department before the start of work

5. Why do I need a Plot Plan/Site Plan; Do I need a new one every time?

A plot plan/site plan is required in conformance with 780 CMR 9th Edition, Section 107.2.5, and is required with every new permit application.
